Special License Agreements

Some design collections are licensed under more restricted licenses than others. Use of the following collections are governed by the accompanying license, which is held by the authority indicted.

EL001

The EL001-Thimbleberries Embroidery Design Collection contains copyrighted designs for home use by the original purchaser only, and is protected under U.S. and international copyright laws. Unauthorized reproduction or distribution of this product, or any portion of it, is forbidden. COMMERCIAL and/or INDUSTRIAL USE or USE for PROFIT, of copyrighted designs or artwork, or any portion thereof, is strictly prohibited. Copyrighted and Trademarked designs are identified by © or TM within the designs. These designs are copyrighted and are licensed for your own personal use. They may not be copied in all or part using any media. To do this violates Federal Copyright Laws. You may not sell, trade, share, copy, loan, rent, lease, transfer, or in any other way duplicated the design file in any part or whole without violating copyright laws.

EL002

Donna's Favorites by Donna Dewberry Design Collection contains copyrighted designs for home use by the original purchaser only, and is protected under U.S. and international copyright laws. Unauthorized reproduction or distribution of this product, or any portion of it, is forbidden. COMMERCIAL and/or INDUSTRIAL USE or USE for PROFIT, of copyrighted designs or artwork, or any portion thereof, is strictly prohibited. These designs are copyrighted and are licensed for your own personal use. They may not be copied in all or part using any media. To do this violates Federal Copyright Laws. You may not sell, trade, share, copy, loan, rent, lease, transfer, or in any other way duplicated the design file in any part or whole without violating copyright laws.

EL004

The Sewphisticates Design Collection by Loralie Harris contains copyrighted designs for home use by the original purchaser only, and is protected under U.S. and international copyright laws. Unauthorized reproduction or distribution of this product, or any portion of it, is forbidden. COMMERCIAL and/or INDUSTRIAL USE or USE for PROFIT, of copyrighted designs or artwork, or any portion thereof, is strictly prohibited. These designs are copyrighted and are licensed for your own personal use. They may not be copied in all or part using any media. To do this violates Federal Copyright Laws. You may not sell, trade, share, copy, loan, rent, lease, transfer, or in any other way duplicated the design file in any part or whole without violating copyright laws.

Basic Agreement

The following license applies to all other Cactus Punch Designs. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE OPENING SOFTWARE PACKAGE. By opening the software package, you agree to the terms of this license. If you do not agree to the terms of the license, do not open or use the software. Promptly return the software and complying materials to the place were you obtained it for a full refund. Returns for opened software will be for damaged disks only and will be replaced with a new version of the same designs.

1. LICENSE: This license permits you to use the enclosed software at only one location. The sale or any other transfer of a copy of the software is a violation of copyright law.

2. COPYRIGHTS: The stock embroidery designs, the software, and the catalog are owned and copyrighted by Cactus Punch and are protected by United States copyright laws and international treaties. You may not copy the software except: a) you may make one copy of the software for back-up or archival purposes; and b) you may transfer the software onto a hard disk provided you keep the original solely for backup or archival purposes. You may not copy the catalog, flyers, or other printed materials which accompany the software.

3. OTHER RESTRICTIONS: You may not rent or lease the software. You may permanently transfer the software provided that you transfer this license and the software together; do not retain any copies of the software; and the recipient agrees to the terms of this license. If the software is sold or otherwise transferred, the parties agree to provide Cactus Punch with the recipient's name, business name, address, telephone number and a list of the software involved with the transfer.

4. WARRANTY DISCLAIMER: Cactus Punch's liability and your exclusive remedy for a defective product shall be replacement of the defective disk within 60 days of purchase. Proof of purchase must be provided.

5. LIMITATION OF DAMAGES: In no event shall Cactus Punch be liable for any consequential damages, including but not limited to business interruption, loss of profits, damaged goods, etc. arising out of the use or loss of use of the software, even if Cactus Punch has been advised of the possibility of such damages.

The software you purchase from Cactus Punch has a registered copyright. By law, software you purchase from Cactus Punch may only be used by your business at one location.
