Exclusive License designs are intended for home use only. You may use licensed designs to make items for your own use and to make gifts for family and friends. Items sewn with Exclusive License designs may not be sold in any form, whether locally or online, for profit or charity, without permission from the licensor. With the purchase of design collections other than Exclusive License designs, you are licensed to produce up to 5000 sewn items with our designs, royalty-free, and you are allowed to modify, add to and adjust the designs to fit your needs for sewing. If a single article contains multiple designs, that item counts against the total for each of the designs individually. If you intend to produce more than 5000 items with a single design, please contact us by letter to obtain large-volume licensing information.

However, you do not own any of these designs, Cactus Punch does. You only own a license to use them. You may not sell, trade, copy, loan, rent, transfer or in any way duplicate the design software in any part or whole without violating copyright law. This means you may not buy or sell designs over the internet, via e-mail, or on a CD-ROM, and you can't "loan" your CD to a friend (even if she is working for you), nor may you copy designs to a floppy for someone else to use, even if you don't charge money.

In the process of selling or exhibiting items embellished with sewn Cactus Punch designs (but NOT Exclusive License designs, see above), it is often necessary to print images of the item in a book, magazine, catalog or poster, and/or display images on a web site. Display of such images is legal and requires no permission from Cactus Punch, so long as there is no implication that the work on display is commissioned by or affiliated with Cactus Punch.

If it is appropriate to acknowledge Cactus Punch as the source of the designs, as in a contest application or magazine article, it is permitted to do so in a legend or caption, or in the main body of a published work. It is not permitted to use the Cactus Punch trademark or logo in any way without expressed written consent from Cactus Punch, nor to use the name Cactus Punch on a label or other feature of the garment or other item in a way that would suggest an association between Cactus Punch and the sewn product.

Items sewn with Exclusive License designs should not be photographed or exhibited without permission from the licensors. Please read the individual license for contact information.

It is illegal to sell opened Cactus Punch design collections on eBay, Yahoo or anywhere else unless you follow the instructions for transferring the license. When you buy the collection, you are really buying a license to use our designs to sew on your sewing machine, and that license is not transferable to any other person except through Cactus Punch. You may sell sewn copies of our designs, but not the actual electronic files. Some people see the disk and think that is what they are buying. It is not. What you are buying is the right for you and you alone to sew those designs. It is only legal to sell complete, UNOPENED design collections.

Cactus Punch has become the premier supplier of machine embroidery design software for home and commercial embroiderers. Our designs are known for their artistry, their smooth sewing, and their variety. We can't maintain our leadership position if our designs are sold illegally on the internet or anywhere else.

Opened collections may never be resold. Once the collection is opened, we must assume that the software was used, thus fulfilling our part of the bargain.
